Probate Court Costs
The fees charged by the Probate Court are set by South Carolina statute. These fees are based on the size of the Probate Estate.
Fee calculation
According to the statute,

If the estate is less than $5,000, the fee is $25.00.

If the estate is more than $5,000.00 but less than $20,000.00, the fee is $45.00

If the estate is more than $20,000.00 but less than $60,000.00, the fee is $67.50

If the estate is more than $60,000.00 but less than $100,000.00, the fee is $95.00
Then one must begin calculating to determine the fee because if the estate is more than $100,000.00 but less than $600,000.00, the fee is $95.00 plus 0.15 percent of the property valuation between $100,000.00 and $600,000.00. For example, an estate of $450,000 would have a fee of $620.00 (0.15 times $350,000 plus $95.00)
For estates over $600,000 the fee is $845.00 plus one-fourth of one percent of the property valuation above $600,000.00.
When are the fees payable?
These fees are due when the estate is opened.
